Form BOC-3 Designation of Process Agents is a simple document that is required by the FMCSA when applying for MC authority. It is a simple form that designates a Process Agent in each of the 50 States. While a process agent is only required in the states that your company actually operates in or through, most carriers and brokers will obtain an agent in all 50 States from the start to avoid having to re-file the form in the future.

A Process Agent, or Registered Agent, is a third party that is authorized to receive legal documents on your behalf. They are required to reside in the State that they are representing you in, and they must maintain a psychical location that is open during normal business hours. The FMCSA requires all registered Motor Carriers and Freight Brokers to maintain a Process Agent in each state that they operate in.

They maintain a network of registered agents in each state, and will electronically file the form on your behalf, for a nominal fee. Most blanket agents only charge a one-time filing fee, though some may charge additional fees if you are ever actually served legal documents.
The agent will also work to regularly maintain and update their list of registered agents to ensure that all information such as names and addresses is kept up to date. This protects your business knowing that legal documents will be served to you in a timely matter without issue.
An added benefit to using a blanket agent is that they will usually monitor your authority status, and electronically forward your letter of operating authority as soon as your application is approved. This can have you in business almost 14 days sooner in some instances, rather than waiting to receive the letter in the mail.
How to Complete the Designation of Process Agent Form
Completing the form when using a blanket agent of process is quick and easy. First, download the BOC-3 form from the Federal Motor Carrier Safety Administration website.
At the top of the first page, enter your MC number or Freight Forwarder number (whichever applies) and the date.
Next, enter your company information. You should use your full legal company name and mailing address.
Don’t worry about the section titled “Person Authorized to Sign Form”. That will be completed by your process agent.
